More broadly, the EU continues to institutionalize externalization in its relations with third countries, for example through the introduction of negative conditionalities between mobility/legal migration opportunities and control-oriented commitments, as well as through funding (e.g. EU Trust Fund for Africa). Migration management and protection obligations are often transferred to non-EU countries through soft law instruments within or outside the EU legal framework. This avoids the political responsibility of the European Parliament, as well as the transparency and judicial oversight of the EU Court of Justice. Due to its mixed legal content and fragmented authorship, the instrument evades the EU’s procedural and institutional framework.
